BASIC CONDITIONS OF EMPLOYMENT ACT, 1997

DETERMINATION: EARNINGS THRESHOLD

I, Membathisi Mphumzi Shepherd Mdladiana, Minister of Labour, hereby in terms of section 6(3) read with section 59(2)(c) of the Basic Conditions of Employment Act, 1997, determine that as from 1 December 1998, all employees earning in excess of R89 455,00 per annum (this amount has been increased to R115 572,00 per annum with effect from 24 March 2003) be excluded from Sections 9, 10, 11, 12, 13, 14, 15, 16, 17 and 18(3) of the Act.

For the purpose of this notice:

"Earnings" means gross pay before deductions, i.e. income tax, pension, medical and similar payments but excluding similar payments (contributions) made by the employer in respect of the employee.
